Welcome to Qcumber (referred to as "Qcumber", "we", "us", or "our"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Software as a Service (SaaS) application (the "Service").

1. Information We Collect
We may collect information about you in a variety of ways. The information we may collect via the Service depends on the content and materials you use, and includes:
a. Information You Provide to Us (Our Company Users)
When you, as a Company, register for an account to use our Service, we collect personal information that you voluntarily provide to us. This information may include:
- Account Information: Your name, company name, email address, phone number, password, and other similar contact or identification information.
- Payment Information: If you subscribe to our paid plans, we collect payment information (e.g., credit card details) through our third-party payment processors. We do not store full credit card numbers on our servers.
- Customization Data: Information you provide to customize your virtual waiting room, such as branding elements (logos, colors) and custom messages.
- Communications: If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.
b. Information Collected by Our Company Users About Their Clients
Our Service allows our Company Users to collect and manage information about their clients ("Clients") for waitlist purposes. This information is collected and controlled by the Company User, and we process it on their behalf. The information typically collected by Companies about their Clients includes:
- Client Contact Information: Name and phone number.
- Client Visit Information: Party size or other relevant details for the waitlist.
Important Note for Companies: You are responsible for ensuring that your collection and use of Client data complies with all applicable privacy laws and regulations, including obtaining any necessary consents from your Clients for the collection of their information and for sending them SMS notifications via our Service. Our role is that of a data processor for this Client data.
c. Information Automatically Collected
When you access or use our Service, we may automatically collect certain information about your device and usage of the Service. This information may include:
- Usage Data: Information about how you use the Service, such as features you use, the pages you view, the dates and times of your access, and other statistics.
- Log Data: Our servers automatically record information created by your use of the Service. Log data may include information such as your IP address, browser type, operating system, referring/exit pages, and device identifiers.
- Cookies and Similar Tracking Technologies: We use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. 2. How We Use Your Information
We use the information we collect (including information from Company Users and information automatically collected) for various purposes, including:
- To provide, operate, and maintain our Service.
- To process your transactions and manage your subscriptions (for Company Users).
- To improve, personalize, and expand our Service.
- To understand and analyze how you use our Service for analytics and service improvement.
- To develop new products, services, features, and functionality.
- To communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the Service, and for marketing and promotional purposes (in accordance with your preferences).
- To send you emails and other communications.
- To detect and prevent fraud and abuse.
- For compliance purposes, including enforcing our Terms of Service, or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.
For Client data processed on behalf of our Company Users, we use this data solely to provide the Service as directed by the Company User (e.g., to send SMS notifications, manage waitlists, and provide analytics to the Company User).
3. How We Share Your Information
We may share the information we collect in the following circumstances:
- With Service Providers: We may share your information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service, SMS delivery services, and marketing assistance. These service providers are authorized to use your personal information only as necessary to provide these services to us.
- For Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- With Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- With Your Consent (for Company Users): We may disclose your personal information for any other purpose with your consent.
- For Legal Reasons: We may disclose your information if we are required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) prevent or investigate possible wrongdoing in connection with the Service, (iv) protect the personal safety of users of the Service or the public, or (v) protect against legal liability.
We do not sell personal information. Regarding Client data collected by Companies, we only share this data as directed by the Company User or as required to provide the Service (e.g., with SMS providers to send messages).
4. Data Retention
We will retain your personal information (for Company Users) for as long as your account is active or as needed to provide you services and to comply with our legal obligations, resolve disputes, and enforce our agreements. Criteria used to determine retention periods include the length of time we have an ongoing relationship with you and provide the Service to you, our legal or compliance obligations, and whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).
For Client data collected by our Company Users, we retain this data according to the Company User's instructions or for as long as the Company User's account is active and requires the data for the Service. Company Users are responsible for their own data retention policies regarding their Clients.
5. Data Security
We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties.
6. Your Data Protection Rights
Depending on your location and applicable law, you may have certain rights regarding your personal information. These rights may include:
- The right to access – You have the right to request copies of your personal data.
- The right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
- The right to erasure – You have the right to request that we erase your personal data, under certain conditions.
- The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.

If you are a Client of one of our Company Users and wish to exercise your data protection rights regarding the information the Company has collected about you, please contact the Company directly. We will assist our Company Users in responding to such requests as appropriate.
If you are in the European Economic Area (EEA) or the UK, you have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.
7. Cookies and Tracking Technologies
We use cookies and similar tracking technologies to collect and use personal information about you, including to serve interest-based advertising (if applicable). Company Users are responsible for ensuring they do not collect information from children in violation of applicable laws via our Service.

Your information, including personal data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and process it there.
